Every mattress sold in the United States carries a white tag sewn into a seam, usually near the foot or along one side, printed with something close to "DO NOT REMOVE UNDER PENALTY OF LAW." It is one of the most misread labels in any American home. The threat is real, but it was never aimed at you, and the tag is worth more to you than most people realize.
The law tag is a consumer disclosure label required by state bedding laws. It tells you what is inside a mattress you cannot see into. On a typical tag you will find:

In the late nineteenth and early twentieth centuries, mattress fillings were unregulated and often grim. Manufacturers stuffed beds with horsehair, corn husks, rags and cotton waste, and some used material salvaged from old or soiled mattresses with no disclosure. A customer had no way to know whether they were buying new cotton or someone else's discarded bedding.
States responded with bedding laws requiring manufacturers to label what was inside and to state whether the materials were new or secondhand. The tag has survived largely unchanged in purpose ever since. It is a transparency rule, not a safety warning.
Sellers. The law was written to stop manufacturers and retailers from stripping off the disclosure before the mattress reached a buyer. It was never meant to stop a customer cutting a tag off their own bed.
The wording caused decades of confusion anyway, which is why modern tags almost always read "This tag may not be removed except by the consumer" or similar. If your mattress is more than a few decades old, you may still have one of the blunter versions. Either way, once you own the mattress, the tag is yours to do with as you like.
There is no penalty for a consumer who removes a law tag from a mattress they bought. There is no agency that fines households over it. The joke is older than most of the people telling it.
Here is the part that actually matters, and it has nothing to do with legality. The law tag is the only permanent identification your mattress carries, and you will need it.
This is the big one. Nearly every mattress manufacturer requires the law tag to process a warranty claim. It proves the model, the manufacturer and the date of manufacture, which is how they establish that your bed is within its warranty period and that it is the bed they made. Remove the tag and you have, in practical terms, thrown away your warranty, even though the warranty is still technically valid. If you ever resell the mattress, the tag tells a buyer it is a genuine article with known contents, and many charities will not accept a mattress without one. This is the original purpose and it still has teeth. If a tag says the contents include secondhand or rebuilt material, or if the tag is missing entirely from something being sold as new, walk away. That is the single most reliable warning sign when buying outside an established retailer, and it is worth reading our guide on whether it is safe to buy a used mattress before you hand over cash.
Start with the materials line. It lists what is inside by proportion, so a tag reading mostly polyurethane foam on a bed sold as a latex mattress tells you something useful. Then find the "all new material" statement, the new-versus-secondhand disclosure.
Next, the registry number. Manufacturers hold a license or registry number issued by the states they sell into, and it appears on the tag, often as a sequence of digits with a state prefix. It identifies who actually built the mattress, which is not always the brand on the box.
Finally, the date of manufacture. This is the one people need most often and look for last. It is your reference point for warranty periods and for working out how old a bed really is, which matters because comfort layers soften long before anything obviously fails. See how long mattresses last.
You are not out of options. Photograph any remaining labels and keep your original receipt or order confirmation. Many brands will work from proof of purchase when the tag has been lost, particularly if you bought from an authorized retailer who still has the sale on file. It is slower than handing over a tag, but it is not hopeless.
Going forward, the easiest insurance is a photograph. Take a clear picture of the law tag the day the mattress arrives and keep it with your receipt. It takes ten seconds and it survives the tag itself.
Bedding label requirements vary from state to state, so if you are dealing with a dispute rather than a routine warranty claim, check your own state's rules or ask the retailer who sold you the bed.

For a consumer, none. For a manufacturer or retailer who strips tags before sale, state bedding laws provide for fines and license consequences, which is who the warning was always addressed to.
Not as a matter of law, but it causes the same outcome in practice. Manufacturers use the tag to verify the model and manufacture date, and most will not process a claim without it or without solid alternative proof of purchase. Treat the tag as part of your warranty paperwork.
Often not. Most retailers require an intact law tag for returns and comfort exchanges so they can confirm the product and its age. Policies vary, so check the specific terms before you cut anything off, and keep the tag attached for the length of any trial period.
